Welcome to Nova, a service operated by Xware VC LLP!

Xware VC LLP ("Nova", "we", "us", or "our") operates the website https://novavoice.app (the "Service").

By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

1. Access to the Service

  • Nova currently offers free access to its voice assistant tools for personal and non-commercial use.
  • In the future, we may offer paid subscription plans for "Pro" users that provide additional features or usage limits. Details of these plans, including pricing and billing terms, will be made available on the Service prior to launch.
  • We reserve the right to modify or discontinue parts or all of the Service at any time, with or without notice.

2. User Data

  • When you use Nova, we may collect information such as your email address and usage activity in order to provide and improve the Service.

3. Non-Personal Data

  • We may use cookies, analytics tools, and other tracking technologies to collect non-personally identifiable data about your interactions with the Service. This information helps us understand user behavior and improve the product experience.

4. Payments and Subscriptions

  • Paid subscriptions (for "Pro" features) will be charged on a monthly basis once introduced. By subscribing, you authorize us to charge your designated payment method on a recurring basis.
  • Users will be able to cancel subscriptions at any time through the account settings page.
  • We may offer trial periods or discounts at our discretion. Refunds are governed by Section 6.

Paid subscription usage must adhere to our Terms of Service, which prohibits, among other things:

  • Abusive usage, such as automatically or programmatically extracting data.
  • Sharing your account credentials or making your account available to anyone else.
  • Reselling access or using Nova to power third-party services.

We have guardrails in place to help prevent misuse and are always working to improve our systems. This may occasionally involve a temporary restriction on your usage. We will inform you when this happens, and if you think this might be a mistake, please don't hesitate to reach out to our support team at: hello@novavoice.app.

If policy-violating behavior is not found, your access will be restored.

5. Consumer Right to Cancel

If you are a Consumer and unless the below exception applies, you have the right to cancel this Agreement and return the Service within 14 days without giving any reason. The cancellation period will expire after 14 days from the day after completion of the Transaction. To meet the cancellation deadline, it is sufficient that you send us your communication concerning your exercise of the cancellation right before the expiration of the 14 day period.

To cancel your order, you must inform Nova of your decision. To ensure immediate processing, please do so by contacting us at hello@novavoice.app. Please note that in respect of subscription services your right to cancel is only present following the initial subscription and not upon each automatic renewal.

Effect of Cancellation

If you cancel this Agreement as permitted above, we will reimburse to you all payments received from you.

We will make the reimbursement without undue delay, and not later than 14 days after the day on which we are informed about your decision to cancel this Agreement.

We will make the reimbursement using the same means of payment as you used for the initial transaction and you will not incur any fees as a result of the reimbursement.

6. Refund Policy

You may request a full refund within 14 days of the date of purchase for one-off purchases. For subscription services, you may request a full refund within 14 days of the date on which your subscription was last renewed (including the initial subscription purchase). This 14-day refund policy applies without exceptions.

To request a refund, contact us at hello@novavoice.app and include the email used at checkout and your order/transaction details. Refunds are issued to the original payment method and processed via Paddle (our payment partner).

We will process refunds without undue delay and, in any event, no later than 14 days after we receive your request. You will not incur any fees as a result of the refund. After the applicable 14-day period, you may cancel future renewals at any time, and your access will continue until the end of the current billing period. We do not provide prorated refunds for unused time outside the 14-day period.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Kazakhstan, without regard to its conflict of law principles.

8. Updates to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date above and may notify you via email or through the Service. Continued use of the Service after changes to the Terms constitutes your acceptance of those changes.
